1. SCOPE
1.1 This Disclaimer ("Disclaimer") applies to all interactions with the conversational AI service marketed as "Hunch" (the "Service") operated by CMA Solutions LLP ("Company"), through WhatsApp, Telegram, the Website at use-hunch.com, and any other channel.
1.2 This Disclaimer is a Constituent Document under the Terms of Service (HUN-LEG-TOS-V3.0) and must be read together with the Privacy Policy (HUN-LEG-PP-V3.0), the Consent Framework (HUN-LEG-CF-V3.0), and the Therapist Handoff Consent and Protocol (HUN-LEG-THP-V3.0, applicable from Version 2 commercial launch).
1.3 By using the Service, the User accepts this Disclaimer in full.
2. NOT A MEDICAL SERVICE
2.1 The Service is not, and shall not be construed as: (a) a medical service, medical device, or medical treatment; (b) a diagnostic facility; (c) a prescriber of medication or therapy; (d) a provider of clinical therapy, psychotherapy, counselling, or psychological assessment; (e) a substitute for consultation with a qualified medical professional.
2.2 Nothing communicated by the Service constitutes: (a) a medical diagnosis; (b) a clinical prognosis; (c) a treatment plan; (d) a medical opinion of any nature.
2.3 The User shall consult a qualified medical professional in respect of any medical concern.
3. NOT A MENTAL HEALTH ESTABLISHMENT
3.1 The Service is not a Mental Health Establishment as defined in Section 2(p) of the Mental Healthcare Act, 2017 ("MHCA").
3.2 The Service does not provide mental-healthcare services, mental-healthcare professional treatment, rehabilitation, or any service requiring registration under the MHCA.
3.3 In Version 2 of the Service, where the Service facilitates referral to a Professional registered with the Rehabilitation Council of India: (a) the Professional operates independently of the Company; (b) the Company does not employ, supervise, direct, or control the Professional's clinical practice; (c) the professional-client relationship is exclusively between the User and the Professional; (d) terms of the Therapist Handoff Consent and Protocol apply.
4. ASTROLOGICAL CONTENT
4.1 The Service uses Vedic astrology (Kundli) as an interpretive framework for the purpose of supporting self-reflection.
4.2 The User acknowledges that: (a) astrological interpretations are not scientifically validated predictions of future events; (b) different astrological traditions and practitioners may interpret the same data differently; (c) the Service's interpretations are generated by automated means and may differ from those of a human astrologer; (d) the accuracy of any interpretation depends materially on the accuracy of the birth particulars provided by the User; (e) no major life decision (including financial, medical, legal, professional, or relational) should be made solely on the basis of astrological insights from the Service.
5. AI-GENERATED OUTPUT
5.1 All responses from the Service are generated by automated systems ("AI Output").
5.2 The User acknowledges that AI Output: (a) may contain errors, omissions, inaccuracies, or fabrications ("hallucinations"); (b) is generated based on patterns in training data and the User's input; (c) is not a substitute for human professional judgment; (d) may vary materially for the same input at different times; (e) shall not be relied upon as definitive, professional, or authoritative.
5.3 Conversation Data is processed by Sub-Processors as described in the Privacy Policy and the Sub-Processor Register.
6. BEHAVIOURAL PATTERN ANALYSIS
6.1 The Service builds behavioural patterns over multiple conversations by correlating self-reported experiences with astrological data.
6.2 The User acknowledges that: (a) such patterns are AI-generated observations, not clinical assessments; (b) patterns reflect only such information as the User chooses to share; (c) patterns shall not be used by the User as a basis for self-diagnosis of any medical or psychological condition; (d) correlation between astrological data and behavioural observations does not imply causation; (e) pattern analysis is intended as a tool for personal reflection only and is not a substitute for professional psychological assessment.
7. SUGGESTED PRACTICES ("REMEDIES")
7.1 Scope of suggestion. The Service may, in the course of conversation, refer to practices drawn from Vedic tradition, including but not limited to mantra recitation, fasting, gemstone-wearing, dietary observance, and ritual practices (each, a "Suggested Practice").
7.2 Strict limitations. Each Suggested Practice is offered subject to the following limitations, which apply in every case:
(a) No medical claim. The Service shall not, and shall not be represented to, prescribe, recommend, or suggest any Suggested Practice as a treatment, cure, prevention, palliation, or alleviation of any disease, disorder, or condition, including those enumerated in the Schedule to the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 ("DMRA").
(b) No mental-health claim. No Suggested Practice shall be linked to the management, alleviation, or treatment of any mental-health condition.
(c) No efficacy claim. The Company makes no representation or warranty as to the efficacy, safety, or scientific basis of any Suggested Practice. The Company expressly disclaims any assertion that any Suggested Practice will produce any specific outcome.
(d) Personal and reflective use only. Suggested Practices are offered solely for personal exploration, cultural engagement, and reflection. They are not advice, prescription, or treatment.
(e) Professional consultation required. Before adopting any Suggested Practice that involves bodily action, dietary alteration, the wearing of an object, the ingestion of any substance, or the expenditure of money, the User shall consult an appropriately qualified professional.
(f) No liability. The Company shall have no liability for any consequence, direct or indirect, arising from the User's adoption of, or refusal to adopt, any Suggested Practice.
7.3 Per-output guardrail. Where the Service references a Suggested Practice in response to a User message, the Service shall include in the same response, or in a closely contemporaneous response, a clear disclaimer in plain language to the effect that: (i) the Suggested Practice is drawn from Vedic tradition; (ii) the Service makes no claim of efficacy; (iii) the User should consult a qualified professional before adopting the practice; (iv) the practice is not a treatment for any condition.
7.4 Editorial controls. The Company maintains an internal editorial-control protocol governing the form and content of Suggested Practice references, and shall not permit references that: (a) link a Suggested Practice to a specific medical condition; (b) assert efficacy without qualification; (c) suggest urgency or fear-based motivation; (d) recommend expenditure not within a reasonable range, or recommend specific vendors of gemstones, herbs, or other items.
8. THIRD-PARTY SERVICES
8.1 The Service depends on the following third-party services, identified in the Sub-Processor Register: (a) WhatsApp Business API (Meta Platforms, Inc. / WhatsApp Ireland Limited); (b) Telegram Bot API (Telegram FZ-LLC); (c) Open Router LLC and Underlying LLM Providers; (d) Razorpay Software Private Limited (payment processing); (e) cloud infrastructure providers.
8.2 The Company is not responsible for: (a) service interruptions, outages, or failures of any third-party service; (b) the data-handling practices of third parties beyond contractual safeguards; (c) changes to third-party terms of service or policies; (d) any loss arising from third-party service failures.
9. DATA AND SECURITY
9.1 The Company implements reasonable security practices and procedures within the meaning of Section 43A of the Information Technology Act, 2000, and Rule 8 of the SPDI Rules, as further detailed in the Privacy Policy.
9.2 Notwithstanding such measures, no electronic system is impervious to compromise. The User shares Personal Data with the Service at the User's own risk.
9.3 The User shall not share through the Service: (a) full payment-instrument numbers; (b) passwords or account credentials of any kind; (c) government-issued identification numbers (Aadhaar, PAN, passport); (d) clinical medical records.
10. NO GUARANTEE OF OUTCOMES
10.1 The Company makes no guarantee as to: (a) the accuracy of astrological interpretations; (b) the utility or effect of any Suggested Practice; (c) any improvement in mental wellbeing, life circumstance, or relational outcome; (d) the suitability or competence of any referred Professional (Version 2).
11. LIMITATION OF LIABILITY
11.1 The limitations on the Company's liability are set out in Clause 11 of the Terms of Service and are incorporated into this Disclaimer by reference.
12. CONSUMER PROTECTION COMPLIANCE
12.1 In compliance with the Consumer Protection Act, 2019 ("CPA") and the Consumer Protection (E-Commerce) Rules, 2020, the Company confirms that:
(a) the Company does not claim that the Service can cure, treat, or diagnose any medical or psychological condition;
(b) the Company does not claim that astrological interpretations are guaranteed to be accurate;
(c) the Company does not engage in unfair trade practices as defined in Section 2(47) of the CPA;
(d) the Company clearly discloses the AI-generated nature of all Service output;
(e) the Company clearly discloses the involvement of third-party AI processors;
(f) the Company clearly discloses the legal name (CMA Solutions LLP), the LLPIN, the principal place of business, and contact information, on the Website and in this Disclaimer (Rule 4(2) of the E-Commerce Rules, 2020).
12.2 A User who considers that any representation of the Company is misleading may: (a) file a grievance under the Grievance Redressal Policy; (b) contact the National Consumer Helpline at 1800-11-4000 or 14404; (c) approach the appropriate Consumer Disputes Redressal Commission; (d) approach the Advertising Standards Council of India in respect of advertising content.
13. MARKETING AND ADVERTISING
13.1 In all marketing communications, social-media content, and promotional materials:
(a) testimonials and user stories (where used) represent individual experience and are not warranted to be typical or guaranteed;
(b) any claim concerning pattern accuracy or insight quality is based on user-reported feedback rather than clinical validation;
(c) marketing content is for informational and promotional purposes only;
(d) all marketing content shall be reviewed for compliance with the DMRA, the CPA, and the ASCI Code prior to publication.
13.2 The Company maintains an internal review process for the production of marketing claims to ensure consistency with the foregoing.
14. AMENDMENTS
14.1 The Company may amend this Disclaimer from time to time. Amendments shall be notified in accordance with Clause 16 of the Terms of Service.
